Appeals Procedure and Judicial Review
- Many municipalities allow the fire prevention chief to modify various provisions of their respective code. To receive consideration for a code modification, the applicant must make a formal request to the authority having jurisdiction (AHJ).
- If the applicant feels the decision reached was unfair, or the code was unfairly enforced or misinterpreted by the inspector, the applicant may file a request for review by a Board of Appeals.
- The Board (usually consisting of 5-7 technical representatives) then makes a ruling on the petition.
Enforcement Procedures
- The fire prevention process must include enforcement procedures to ensure compliance with the fire code
