Inspector Liability

• In 1976, the court held that fire inspectors, in conducting code enforcement inspections, had taken on a duty and must use reasonable care in the exercise of that duty.
• Generally, inspectors are not held liable for discretionary acts (actions necessary to fulfill their responsibility).

e.g. After inspecting property and determining violations of the code, but fail to follow up to ensure that violations are corrected, the inspector may be held liable if a fire occurs. It is better to conduct fewer but more thorough inspections and to follow up on all violations than to perform many inspections in a haphazard, incomplete, or negligent manner.
